    1. Our Commitment to Children's Privacy

TalkSanta is committed to complying with the Children's Online Privacy Protection Act (COPPA). We understand the importance of protecting children's personal information and take special precautions when our Service is used by or on behalf of children under the age of 13.

    2. Parental Consent

We require that children under 13 use our Service under the supervision of a parent or legal guardian. Account creation requires an adult to register and manage the account. By creating an account and allowing a child to use the Service, the parent or guardian provides verifiable consent for the collection of limited information necessary to deliver the Service.

    3. Information We Collect from Children

When a child interacts with the Service through a parent-managed account, we may collect:

    • Voice data: Audio input during live sessions, processed in real-time for AI interaction and not permanently stored as raw audio.
    • Session transcripts: Text records of conversations during sessions, stored under the parent's account.
    • Usage data: Session duration and feature usage to improve the Service.

We do not collect personal information directly from children, such as name, email, address, or phone number. All account-level information is provided by the parent or guardian.

    4. How We Use Children's Information

Information collected during a child's session is used solely to:

    • Deliver the interactive AI experience in real-time.
    • Improve the quality and appropriateness of AI responses.
    • Ensure content moderation and safety standards are maintained.

    5. Data Sharing

We do not share, sell, or rent children's personal information to third parties for marketing or any unrelated purpose. Data may only be shared with service providers essential to delivering the Service (e.g., AI processing, hosting), and such providers are contractually obligated to protect this information.

    6. Parental Rights

Parents and legal guardians have the right to:

    • Review information collected from their child's sessions.
    • Request deletion of their child's session transcripts and associated data.
    • Refuse further collection or use of their child's information.
    • Close the account, which will delete all associated data.

To exercise any of these rights, parents may use the account settings or visit our Contact page.

    7. Data Security

We maintain reasonable security measures to protect information collected from children, including encryption, access controls, and regular security audits.

    8. Content Safety

Our AI system is designed with content moderation safeguards to ensure interactions remain age-appropriate. Conversations are monitored for safety, and the AI is trained to respond in a manner suitable for all ages.
